Twitch and its parent company Amazon are facing a proposed class action lawsuit after admitting to using creator broadcasts to train generative AI models without consent or compensation. Filed in the Northern District of California by streamer Warren Pandiscia, the complaint argues that harvesting VODs, past clips, chat logs, and photos violates state unfair competition laws and breaches creators' trust. The legal challenge arrives on the heels of Twitch confirming that the data collection is active by default across the platform.
Community pushback has been immediate and fierce, particularly regarding the opt out mechanism. Twitch chief product officer Mike Minton defended the default setting by stating that nobody would opt in if given a choice from the start. Furthermore, the opt out feature is not retroactive, and it only applies to individual channels rather than entire accounts. This means a creator who actively opts out can still have their content harvested if they appear in a collaboration with someone who has not done the same.
